These Terms of Use (“Terms”) govern your use of livehealth.store (the “Site”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site is
The Site republishes recall and enforcement information made public by the U.S. Food and Drug Administration and the U.S. Department of Agriculture, organised by product, brand, company, store, reason and state, together with summaries, counts and email alerts. It is an information service. It is not affiliated with, endorsed by or maintained by any government agency, manufacturer or retailer.
2. No medical, legal or professional advice
Nothing on the Site is medical advice, and nothing on the Site creates a doctor-patient or other professional relationship. Recall pages describe what the agency has published; they do not tell you whether a product you own is affected or what you should do about it. Always follow the instructions in the official recall notice and consult a physician, pharmacist or other qualified professional about your own situation. In an emergency call 911.
3. Accuracy and completeness
We work to keep the Site accurate and current, but recall data is supplied by third parties, can change without notice and may contain errors or omissions. The FDA itself labels its openFDA data as not validated. We do not warrant that any record is accurate, complete or up to date, that a product is or is not subject to a recall, or that the Site will be available without interruption. You use the Site at your own risk.
4. Permitted use
You may browse the Site, link to any page, quote short excerpts with attribution and a link, and use our counts and summaries in articles, research and personal decisions. You may not: copy or scrape the Site in bulk or republish substantial parts of it; use automated tools that place an unreasonable load on our servers; remove notices, attribution or links from material taken from the Site; misrepresent the Site as an official government source; or use the Site for any unlawful purpose.
5. Intellectual property
Underlying recall records are works of the United States government and are in the public domain. The selection, arrangement, classification, summaries, generated text, design, code and branding of the Site are owned by the Site operator and protected by copyright and other laws. Trademarks, brand names and company names shown on the Site belong to their respective owners and are used only to identify the products and companies in the public record.
6. Email alerts
Alerts are a free convenience sent to the address you supply after you confirm it. Delivery is not guaranteed; do not rely on an alert as your only way of learning about a recall. You can unsubscribe with the link in any message.
7. Third-party links and advertising
The Site links to government notices and other external sites, and displays advertising served by third parties. We are not responsible for the content, accuracy or practices of external sites or advertisers. An advertisement is not an endorsement.
8. Limitation of liability
To the fullest extent permitted by law, the Site operator and anyone who works on the Site will not be liable for any direct, indirect, incidental, consequential, special or punitive damages, or for any loss of profit, data or goodwill, arising out of or in connection with the Site or your reliance on anything published on it, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the greatest extent the law allows. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
9. Indemnity
You agree to indemnify and hold harmless the Site operator from any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
10. Changes
We may change the Site or these Terms at any time. Changes take effect when posted on this page, and the date at the top of this page shows when it was last revised. Continued use after a change means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws of the United States and, to the extent they apply, the laws of the state in which the Site operator is based, without regard to conflict-of-law rules. If any part of these Terms is found unenforceable, the rest remains in effect.
